When this Privacy Notice does not apply

This Privacy Notice does not apply to personal information we process on behalf of customers who use our Services. Where we process personal information on behalf of customers, this is instead governed by the contractual data processing terms we have agreed with those customers. If you have any questions about personal information we process on behalf of a customer, please contact the relevant customer directly.

1. Information you provide voluntarily

  • Services data: This is personal information you provide whilst using the Vizrt services, including when seeking customer support from us in connection with the Services. The specific data we process will depend on the service you use and how you use it (including, but not limited to, whether you are a user of Viz Flowics, Viz Story, Viz Now, Vizrt Forums and Viz University), and may include user-generated content that you choose to integrate into your use of the Service (social media posts, comments, and other content collected for integration into live broadcasts), and audience interaction data (information from interactive features such as polls, quizzes, and ratings that you use in the Service, reflecting viewer participation and responses). If you are an enterprise customer, we process services data pursuant to the data processing terms we have agreed with you.
  • Communications data: This is personal information relating to any correspondence you send us (for example, questions or feedback you send about our Website or our Services). We will collect information such as the communication type, language preference, content, subject, sender, recipient and date.
  • Payment data: This is personal information you provide to purchase Services through our Website or by contacting us directly. We will collect information about the Services purchased, the payment amount, payment method, date of purchase, financial correspondence, purchasing behaviour, payment information descriptions of chains of events (and other relevant circumstances) and your purchase history.

1. Data controller

2. EEA/UK legal basis

We will ordinarily collect and use your personal information only where (i) we have your consent (which will be apparent from the context, because we will ask for your consent when you provide your personal information); (ii) it is necessary to perform a contract with you (for example, we must process your payments data in order to fulfil any order you place with us), in which case we will be unable to fulfil our contract with you if you do not provide necessary information; (iii) the use is within our legitimate interests and not adverse to your rights and freedoms (for example, to send you marketing communications, provided this is consistent with your communications preferences); or (iv) it is necessary for compliance with a legal obligation.

3. International transfers

If Vizrt transfers your personal information to a country outside of the EEA (for EEA residents) or the UK (for UK residents), it will ensure that any such transfers are compliant with EU and UK data protection law, as applicable.

In practice, this means that Vizrt will only transfer your personal information to a non-EEA or non-UK recipient where: (i) the recipient is located in a country that the European Commission has decided is adequate to receive personal information from the EEA or the UK Secretary of State has decided is adequate to receive personal information from the UK (as applicable); (ii) the recipient has signed appropriate contractual terms with Vizrt that incorporate the European Commission’s Standard Contractual Clauses or the UK Information Commissioner’s International Data Transfer Agreement or International Data Transfer Addendum (as applicable); or (iii) a data transfer derogation applies (for example, where you have consented to the transfer of your personal information).

California Resident Privacy Rights

If you are a California resident, in addition to the rights described above under this “Global Rights & Choices” section, you have the following rights. Our business customers are afforded certain rights under the CCPA identified with an asterisk (*) below.

  • Right to Access Specific Information. You may request access to the categories and specific pieces of personal information we have collected, used, and disclosed about you in the twelve (12) months preceding your request.
  • Right to Know Personal Information. You may request to know the categories of personal information we have collected about you and the purposes for doing so; the categories of sources of that data; the categories of third parties with whom we shared it for a business purpose and our purposes for doing so.
  • Right to Opt Out of Sale or Sharing of Personal Information*. The terms “sale” and “share” are defined broadly under the CCPA. To the extent that Vizrt engages in the selling or sharing under the CCPA, we will comply with applicable law as to those activities, including by providing an opportunity for you to opt out or limit you preferences as afforded under the CCPA.
  • Right to Delete your personal information. You may request the deletion of your personal information, subject to certain limitations under applicable law.
  • Non-Discrimination*. We will not discriminate against you for exercising any of your privacy rights under CCPA or applicable law, including by denying you goods or services, charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties, providing you a different level of quality of goods or services, or suggesting that you will receive a different price or rate for goods or services or a different level of quality of goods or services.

Submission of requests, verification and authorized agent

To exercise your rights, please follow the instructions above and the contact information in the “About Vizrt us” section above. We will confirm receipt of your requests and respond within 30 calendar days, unless additional time is needed, in which case we will provide notice and an explanation of the reason. Also, to respond to your request to right to know and/or delete, we must verify your identity or authority to make the request and confirm the personal information relates to you, or others. To do so, we collect your name, e-mail address, phone number to verify your identity. We also may contact you by e-mail or by telephone to verify your identity and ask you additional questions so that we can match your identity with the data we have about you. In some instances, we may ask you to declare under penalty of perjury that you are the consumer whose personal information is the subject of the request. If we cannot verify your identity, we may reject your request in whole or in part.

You also may designate an authorized agent to make a request for you. To use an authorized agent, we may require: (1) your signed permission designating the authorized agent; (2) evidence that the authorized agency has power of attorney under the California Probate Code; or (3) proof that the authorized agent is registered with the California Secretary of State and that you have authorized such authorized agent to be able to act on your behalf.
